These terms have been drafted in plain language and are being reviewed by counsel; the current text applies.
These terms set out the agreement between you and VTEPCare when you use vtepcare.com and the VTEPCare app. By creating an account or using the service you accept them, together with the privacy policy.
VTEPCare is a family growth-profile service. It keeps one record of a person's learning, sport, creativity, fitness and wellbeing over time, and MAI, an AI guide, helps you read that record and choose a useful next step. It is offered from Quebec, in English, French and Vietnamese.
An account may only be opened by an adult (18 or older) who is able to enter into a contract. Creating an account may require an access password we give you; a password given to you is for your own use. You are responsible for everything done with your account.
A profile for a person under 18 may only be created by that person's parent or legal guardian, who consents on the child's behalf and remains responsible for what is recorded. You may invite a teenager to see or add to their own profile. When you invite anyone else (a coach, a teacher, a relative) you confirm that you are entitled to share the child's information with them, and you can remove their access at any time.
Keep your password private and tell us through the contact page if you believe someone else has used your account. You must give a working email address, since that is how we confirm the account, reset the password and reach you about the service. You may close your account at any time; what happens to the data is described in the privacy policy.
You agree to use VTEPCare for the purpose it was built for: keeping and understanding a growth profile for yourself or for people you are responsible for. In particular, you will not:
VTEPCare is an informational coaching and screening tool. The numbers, trends, projections and suggestions it shows are drawn from the information you entered and are meant to help a family decide what to try next. They are not medical, psychological or educational advice or diagnosis, and they do not replace a doctor, a psychologist, a teacher, a coach or a school. Where the app offers a screening check, it records the result and the follow-up; a result that needs attention must be assessed by a professional. If you are worried about someone's health or safety, contact a professional or the emergency services.
MAI is built on a language model and can make mistakes, including stating something that is wrong or missing something that matters. Read what it suggests with judgement, check anything important against a reliable source, and remember that you decide. MAI reads the profile you are working in and drafts; calculations are made by deterministic code so that a number means the same thing every time.
You keep every right in the information and files you add to VTEPCare. You give us only the permission needed to store, display, process and back them up in order to provide the service to you and the people you invite, including sending the parts MAI needs to the AI provider named in the privacy policy. We do not sell this information and we do not use it for advertising. You can export it and you can delete it.
We may suspend or close an account that breaks these terms, that puts a child or another person at risk, or that threatens the security of the service, and we will tell you why unless the law prevents it. You may close your account at any time. When an account is closed, the data is handled as described in the privacy policy.
VTEPCare is an evolving service, and some parts are still being built. We do our best to keep it available and to keep your record safe, but we cannot promise that it will be free of interruptions or errors. We may add, change or withdraw features; where a change removes something you rely on, we will give you reasonable notice and a way to export your record.
We are responsible for providing the service with care and for protecting your information as the law requires, and nothing in these terms limits a right that consumer or privacy law gives you and that cannot be waived. Beyond that, VTEPCare is not responsible for decisions you take on the basis of what the service shows, for loss caused by information that was entered incorrectly or incompletely, for interruptions outside our control, or for indirect losses such as lost opportunities. Where the law allows us to limit our liability, it is limited to the amount you paid us for the service in the twelve months before the event.
These terms are governed by the laws of Quebec and the federal laws of Canada that apply there. A dispute that cannot be settled between us is brought before the courts of Quebec. If you are a consumer, nothing here removes the protections of the Consumer Protection Act or your right to complain to the Office de la protection du consommateur or the Commission d'accès à l'information du Québec.
When we change these terms in a way that matters, we update the version and date shown below and tell account holders by email or in the app before the change takes effect. Using the service after that date means you accept the new terms; if you do not, you may close your account.
Questions about these terms reach us through the contact page.
